In 2023, The Vietnamese National Assembly has enacted the Law amending and supplementing a number of articles of the "Law of Entry, Exit, Transit, and Residence of Foreigners in Vietnam", represents a significant step forward in promoting tourism and promoting foreign relations.

    • Vietnam issues electronic visa (E visa Vietnam) to citizens of all countries and territories around the world from August 15, 2023 according to Resolution No. 127/NQ-CP;
    • Vietnam issues electronic visas to foreigners with a term of 90 days (3-month electronic visa), visa is valid for one time or multiple times;
    • Vietnam has extended  the duration of temporary residency permits issued at border crossings for citizens of select countries, including Japan, who are eligible for visa-free entry. The extended period now allows for stays of up to 45 days.
  • Conditions for Japanese to obtain a visa for entry into Vietnam

Each type of visa has specific requirements for issuance. For instance, to apply for a work visa, Japanese citizens must first obtain an invitation or permanent residence sponsorship from a Vietnamese agency, organization, or individual. And a relative visit visa will be granted to Japanese citizens who have a spouse or children under 18 years old who are also foreigners holding a valid Vietnam visa,... To be eligible for a Vietnam visa, Japanese citizens must meet the following general conditions:

  • You must have a passport or a valid international travel document.
  • You have been invited or guaranted by agency, organization or individual in Vietnam, excepting:
  • Issue electronic visa at the request of foreigners;
  • Issue electronic visa at the request of agencies and organizations;
  • Issue visa to foreigners wishing to enter Vietnam for market survey, tourism, visiting relatives, or medical treatment;
  • Not falling under the cases where entry is not allowed according to the Law on entry, exit, transit, and residence of foreigners in Vietnam.
  • Extending Visa procedure:
  • Step 1: Japanese individuals seeking to extend their visa in Vietnam must submit a complete application to the Immigration Department.
  • Step 2: If the dossier is complete, it will be submitted for processing. You will receive an appointment letter to return the results. The Immigration Department will review your application within 7 to 10 days.
  • Temporary residence card

Temporary residence card (TRC) in Vietnam is a document that issued by an immigration authority or the Ministry of Foreign Affairs to Japanese who is permitted to reside in Vietnam for a certain period of time. TRC has the same validity as a visa. The biggest advangtage of TRC compared to visa is that you do not need to applying for an extension, you can still enter and exit the country multiple times during the term of your temporary residence card, so if you plan to stay in Vietnam for an extended period of time, apply for a temporary residence card rather than wasting time applying for a visa.

(2) Procedures for applying for work permits for Japanese citizens in Da Nang, Vietnam

  • Conditions for obtaining a work permit for Japanese citizens in Da Nang, Vietnam

According to the provisions of Article 151, Labor Code 2019, foreign employees who work in Vietnam must meet the following conditions:

  • At least 18 years of age and has full legal capacity;
  • Have professional qualifications, relevant skills, work experience for the job position and adequate health as prescribed by the Minister of Health;
  • Must not have a criminal record, be currently serving a sentence, or be subject to criminal prosecution under either Vietnamese or foreign law;
  • Procedures about granting work permits for Japanese in Da Nang, Vietnam

Step 1: At least 15 days prior to the anticipated start date of employment in Vietnam, the individual submitting the work permit application must submit the necessary documents to the Department of Labor, War Invalids, and Social Affair.

Step 2: Within 05 working days from the date of receiving complete application documents for a work permit, Department of Labor, War Invalids and Social Affairs where the foreign worker expect to work, issue work permits to foreign workers follow the Form No. 12/PLI, Appendix I issued with Decree No. 152/2020/ND-CP.

In case a work permit is not issued, there will be a written response clearly stating the reason.

(3) Which country's law will govern Japanese who commit crimes in Da Nang, Vietnam?

About violations of criminal law: according to the provisions of Article 5 of the Criminal Code 2015, The Criminal Code applies to every criminal offence committed within the territory of the Socialist Republic of Vietnam.

It also applies to criminal offences committed on sea-going vessels and airplanes having Vietnamese nationality or operating in Vietnam’s exclusive economic zones or continental shelves, or consequences thereof.

For foreign nationals who commit offenses on the territory of the Socialist Republic of Vietnam and are entitled to diplomatic or consular immunity under Vietnamese law, international treaties to which the Socialist Republic of Vietnam is a party, or international customs, their criminal liability shall be addressed in accordance with the provisions of those international treaties or customs. In cases where such international treaties do not provide guidance or where there are no applicable international customs, their criminal liability shall be resolved through diplomatic channels.
