Regarding temporary and permanent residence of foreigners in Vietnam (the second issue)

1. Temporary residence

• Visa holders with the symbols LV1, LV2, LS, ĐT1, ĐT2, ĐT3, NN1, NN2, DH, PV1, LĐ1, LĐ2, TT will be issued temporary residence cards with corresponding symbols. For foreigners who are members of diplomatic missions, consular offices, representative offices of international organizations of the United Nations, intergovernmental organizations in Vietnam and their spouses, children under 18 years old, their servants who go along in that term will be granted temporary residence cards denoted NG3.
• The duration of the temporary residence card shall be at least 30 days shorter than the remaining period of the passport. Temporary residence card with symbol ĐT1 has a duration of no more than 10 years. Temporary residence cards with symbol NG3, LV1, LV2, LS, ĐT2 and DH have a duration of no more than 05 years. Temporary residence cards with symbol NN1, NN2, ĐT3 and TT have a duration of no more than 03 years. Temporary residence cards with symbols LĐ1, LĐ2 and PV1 have a duration of no more than 02 years.

2. About permanent residence

Foreigners are considered for permanent residence in Vietnam if they have legal accommodation and have stable income to ensure life in Vietnam and must fall into one of the following cases:

• Foreigners who have merits and contributed to the cause of building and protecting Vietnam’s homeland and are awarded the state medal or honorary title.
• Foreigners who are scientists or experts temporarily residing in Vietnam and are proposed by ministers, heads of ministerial-level agencies or government-attached agencies in their fields of expertise.
• Foreigners who are bailed out by their parents, spouses or children who are Vietnamese citizens and are permanently residing in Vietnam and foreigners who have been temporarily residing in Vietnam for 03 years or more.
• Stateless persons who have resided in Vietnam continuously since 2000 or earlier.

3. About exit and entry into Vietnam

Foreigners are allowed to enter Vietnam when they fully meet the following requirements:

• Having passports or documents valid for international travel and visas, except in case of visa exemption. Foreigners who enter by visa exemption, their passports must be valid for at least 6 months;
• Not in the case of not allowing entry such as:
  • Not meeting the above requirements;
  • Children under 14 years old without parents, guardians or authorized person accompanying them;
  • Falsification of false documents or declarations to be granted valuable documents for entry, exit or residence;
  • Persons suffering from mental illness or infectious diseases that endanger public health;
  • Being expelled from Vietnam for less than 3 years from the effective date of the expulsion decision;
  • Being forced to exit from Vietnam for less than 6 months from the effective date of the decision;
  • For reasons of disease prevention and control;
  • For reasons of natural disasters;
  • For reasons of national defense, security, social order and safety.

4. Foreigners who use e-visas for entry must enter through international border gates decided by the Vietnamese Government.

5. Foreigners are allowed to exit when they fully meet the following conditions:

• Having passports or documents valid for international travel;
• The temporary residence certificate, temporary residence card or permanent residence card is still valid;
• Not in the case of being suspended from exit, such as:

• Being an accused, defendant, person with relevant obligations in criminal cases or being a defendant, defendant, person with related obligations in civil, business, commercial, labor, administrative, marriage and family cases;
• Being obliged to serve judgments or decisions of courts or decisions of competition adjudication councils;
• Not having fulfilled tax payment obligations;
• Being obliged to serve administrative sanctioning decisions;
• For reasons of national defense and security.

• Foreigners who use e-visas for exit must exit through international border gates decided by the Vietnamese Government. Foreigners may be forced to exit the country when the temporary residence period expires but they do not leave the country or for reasons of national defense, security, social order and safety.
