1.      What is Inheritance?

Inheritance is understood as the transfer of property of the deceased to the living, the property left is called an estate. The time of the opening of an inheritance is the time of the death of the person with property. In case the Court declares a person dead, the time of opening the inheritance shall be the date specified in Article 71.2 of the 2015 Civil Code.

In particular, inheritance is divided into two forms:

• Inheritance under a testament refers to transferring the property of own the deceased to survivors under their wishes when they are still alive (Article 624 of the 2015 Civil Code);
• Inheritance by intestacy laws refers to transferring the property of own the deceased to survivors according to order of succession, requirements and orders are regulated by intestacy laws. (Article 649 of the 2015 Civil Code).
